1. Acceptance of Terms

By accessing or using Foxfire ("the Service"), operated at foxfire.wymzy.ai by WYMZY INDUSTRIES LLC ("WYMZY," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of Foxfire after changes take effect constitutes acceptance of the revised Terms.

2. Description of Service

Foxfire is a web-based digital business card and portfolio builder. The Service allows you to create, customize, and share digital business cards containing your professional information, contact details, social links, portfolio items, and action buttons. Cards are accessible via a public URL, QR code, or downloadable vCard.

The Service includes a free tier for building and previewing cards, and a paid subscription for publishing cards to a public URL.

3. Accounts

To use Foxfire, you must sign in with a Google account via OAuth. You are responsible for maintaining the security of your Google account credentials. You agree not to share your account access with others or allow unauthorized use of your account.

You must provide accurate and complete information when creating your account and cards. You are responsible for all activity that occurs under your account. If you become aware of any unauthorized use, contact us immediately at info@wymzy.ai.

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

4. Subscriptions, Billing & Cancellation

Foxfire offers a paid subscription ("Foxfire Pro") at $4.99 per month. A subscription is required to publish your card to a live, publicly accessible URL. Building and previewing cards is free and does not require a subscription.

Billing

Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. All prices are in U.S. dollars. Stripe processes and stores all payment information — we never have access to your full credit or debit card number.

Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, your subscription remains active through the end of your current billing period. Your published card will remain live until that period ends, after which it will be unpublished. You will not be charged again after cancellation.

Refund Policy

We do not offer refunds for partial billing periods. When you cancel, you retain full access to your subscription benefits through the end of the current billing cycle. No prorated refunds will be issued. If you believe you were charged in error, contact us at info@wymzy.ai and we will review your case.

Price Changes

We reserve the right to change subscription pricing. If we do, we will provide at least 30 days' notice before the new price takes effect. Your continued subscription after the new price goes into effect constitutes acceptance of the updated pricing.

5. User Content

You retain full ownership of all content you upload, create, or provide through the Service, including text, images, links, and portfolio materials ("User Content").

By using the Service, you grant WYMZY INDUSTRIES LLC a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service. This license exists only to enable us to display your card to visitors, generate QR codes, provide vCard downloads, and otherwise deliver the features of Foxfire. This license terminates when you delete your content or your account.

You represent and warrant that you own or have the necessary rights to all User Content you provide, and that your content does not infringe on the intellectual property rights or other rights of any third party.

6. Acceptable Use

You agree not to use Foxfire to:

• Upload, publish, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Impersonate any person or entity, or falsely represent your affiliation with a person or entity
• Distribute spam, phishing links, malware, or any other harmful or deceptive material
• Attempt to gain unauthorized access to the Service, other accounts, or any systems or networks connected to the Service
• Use the Service for any illegal purpose or in violation of any applicable local, state, national, or international law
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Scrape, crawl, or use automated means to access the Service for any purpose without our express written permission
• Upload content that infringes on any patent, trademark, trade secret, copyright, or other proprietary right of any party

We reserve the right to remove any User Content and suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

7. Intellectual Property

The Foxfire name, logo, branding, visual design, and all proprietary technology underlying the Service are the exclusive property of WYMZY INDUSTRIES LLC. The WYMZY name and associated product names (Foxfire, Mudpuppy, Bullfrog, Persimmon, Muscadine, Yellowjacket) are trademarks of WYMZY INDUSTRIES LLC.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software, nor may you reverse-engineer or attempt to extract the source code of the Service, unless applicable law permits it or you have our written consent.

8. Termination

You may stop using the Service and delete your account at any time. Upon account deletion, your User Content will be permanently removed from our servers within 30 days.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or illegal activity, extended periods of inactivity, or requests by law enforcement.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and governing law.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant the accuracy, reliability, or completeness of any content available through the Service.

You use the Service at your own risk. We are not responsible for the actions or content of any third parties, including visitors who view your published cards.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WYMZY INDUSTRIES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service by any third party
• Any content or conduct of any third party on the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $50.00, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless WYMZY INDUSTRIES LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Union County, Arkansas.

Before filing any claim, you agree to first contact us at info@wymzy.ai and attempt to resolve the dispute informally for at least 30 days.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WYMZY INDUSTRIES LLC regarding your use of the Service, and supersede any prior agreements between you and WYMZY INDUSTRIES LLC relating to the Service.
